2. Acceptance of These Terms

By accessing this website or enrolling in the mentorship program, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our Services.

3. Description of Services

We provide live, small-group Japanese language mentorship sessions, JLPT-focused practice, a personalized study roadmap, and access to a custom kanji and vocabulary app with spaced repetition, delivered on a recurring 4-week cycle.

4. Enrollment and Payment

• Enrollment is initiated by contacting us through Discord, WhatsApp, or email, as described on our website.
• The mentorship program is billed on a recurring 4-week cycle. Pricing is displayed in RON, EUR, or USD depending on your location, and is subject to change with reasonable notice for future cycles.
• Payment may be made by bank transfer to the account listed in Section 1, or by any other method we make available at the time of enrollment.
• Access to live sessions and the vocab app for a given cycle is conditional on payment for that cycle being received.

5. Cancellation and Right of Withdrawal

You may cancel your subscription at any time, effective at the end of the current 4-week cycle. Cancellation does not entitle you to a refund for sessions already delivered or for the portion of the cycle already elapsed.

If you are a consumer entering into this contract at a distance, Romanian law (GEO no. 34/2014) grants you the right to withdraw from the contract within 14 calendar days without giving any reason. However, where you request that live sessions begin before the end of this 14-day period, you acknowledge and expressly agree that you lose the right of withdrawal once the service has been fully performed, in accordance with the exceptions provided by that law.

6. Your Responsibilities

• Provide accurate contact and billing information;
• Attend scheduled live sessions and communicate promptly regarding rescheduling needs;
• Ensure you have the equipment and internet connection necessary to join live sessions on the platform used to host them;
• Use the kanji and vocabulary app for your own personal, non-commercial study only.

7. Intellectual Property

All course materials, the study roadmap, the kanji and vocabulary app, and related content are the property of Kitsunebi Miyabi SRL or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use these materials for your own personal learning while enrolled in the program. You may not reproduce, redistribute, or resell any course materials without our prior written consent.

8. Third-Party Platforms

Live sessions and communications are conducted through third-party platforms such as Discord, WhatsApp, and Gmail. We are not responsible for the availability, security, or policies of these platforms, and your use of them is also subject to their own terms of service.

9. Limitation of Liability

To the maximum extent permitted by law, Kitsunebi Miyabi SRL shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid for the current subscription cycle. Nothing in these Terms limits any liability that cannot be limited under applicable Romanian consumer protection law.

10. Termination

We may suspend or terminate your access to the Services if you breach these Terms or fail to make payment for a subscription cycle. You may terminate your enrollment at any time in accordance with Section 5.

11. Complaints and Alternative Dispute Resolution

If you have a complaint, please contact us first at vici.sensei@gmail.com so we can try to resolve it directly. As a consumer, you are also entitled to use the Alternative Dispute Resolution (SAL) platform operated by the Romanian National Authority for Consumer Protection (ANPC), accessible at reclamatiisal.anpc.ro, as well as the European Commission's Online Dispute Resolution platform.

12. Governing Law

These Terms are governed by Romanian law. Any dispute that cannot be resolved amicably or through the SAL platform referenced above shall be submitted to the competent courts of Romania.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Continued use of our Services after an update constitutes acceptance of the revised Terms.
